A five-judge Supreme Court panel recently ruled that in situations where a marriage has irretrievably broken down, the court may exercise its authority under Article 142 of the Constitution to issue a divorce decree directly to parties who have given their consent. It would be unnecessary to refer the parties to a family court where they would have to wait 6 to 18 months for a decree of divorce by mutual consent if this were to take place.
